Week 5 – Assignment 1: Compile a Chart Detailing EMTALA Requirements and Obligations

This week, you examined organizations’ obligations to their employees and patients. As you know, patients presenting in emergency situations are covered under EMTALA. Locate the law and, in chart form, concisely detail the statute requirements. Be sure to include:

1. Obligations of EMTALA, including who is covered and what they must do to be in compliance.

2. Requirements for transferring patients.

3. Types of specific penalties for violating EMTALA requirements.

Make sure to look directly at the law. List the location of the requirements in the statute by section and include applicable ethical principles at play.

Week 5 – Assignment 2: Appraise Case Law Dealing with the Family Medical Leave Act (FMLA)

This week, you reviewed a healthcare organization’s right to provide leave to its employees under the FMLA. As the definition of
family continues to broaden, the FMLA provides a vague notion of coverage, in some respects. Now is your chance to examine the FMLA’s requirements in more detail.

Your healthcare organization is developing a new FMLA policy and has asked you to draft a memo detailing the impact of recent FMLA cases on that policy. Review
Coutard v. Municipal Credit Union and
Fitzgerald v. Shore Memorial Hospital to help prepare your presentation to management. Review these cases and summarize your findings as they would apply to your organization. Be sure to examine:

1. Applicable provisions of the FMLA, including what type of family members are considered under the Act.

2. How the cases
Coutard v. Municipal Credit Union and
Fitzgerald v. Shore Memorial Hospital will impact the hospital’s policy.

3. Provide recommendations on how the hospital should deal with situations where employees ask for FMLA leave for individuals other than parents, spouses, or children.
