One of the key concepts presented in this unit is the unintentional tort of negligence. From our readings for this unit, you will find that negligence can take a few different forms and is a common reason for medical malpractice.
For this case study, you will be locating a case on medical malpractice and outlining the lawsuit revolving around negligence. You should introduce your case study and discuss its relationship to two important aspects of negligence:
- the performance, or lack thereof, of the medical act, and
- the elements needed to prove negligence often called the “four Ds of negligence.”
Classify the lawsuit you are discussing as malfeasance, misfeasance, or nonfeasance, and explain which element (duty, dereliction, damage, and/or direct cause) proves the guilt of the health care professional and/or medical provider. In addition, provide other important aspects of the case beginning with the origin of the lawsuit, the court proceedings (up to the monetary, criminal, and/or licensure punishments).
